65 Partner leaving partnership
S. 65(1) amended by No. 58/2011 s. 104(Sch. item 4.118).
If the Commission is satisfied that a member of a partnership that is a licensee or permittee has left the licensed premises and has no intention of returning to the premises to take up his or her duties as a licensee or permittee, the Commission may remove the name of that person from the licence or BYO permit.
If a person's name is removed from a licence or BYO permit under subsection (1)—
the remaining members of the partnership are deemed to be the licensees or permittees; or
if the partnership is dissolved, the former member or members remaining in occupation of the licensed premises are deemed to be the licensees or permittees.
