28 Risk fee—non‐compliance in relevant period
This regulation applies to a licence or BYO permit if one or more non‑compliance incidents have occurred in respect of the licensed premises in the relevant period.
The risk fee for non‑compliance incidents in the relevant period is—
if there are one or two non‑compliance incidents that relate to the licence or permit in the relevant period, 750⸱12 fee units; or
if there are 3 or more non‑compliance incidents that relate to the licence or permit in the relevant period, 1500⸱25 fee units.
For the purposes of subregulations (1) and (2), a non‑compliance incident does not include a non‑compliance incident to which a demerit point relates if that demerit point has been removed from the Register under section 86HA or 86I of the Act.
