30A Civil action for failure to comply with information notice or inspection notice
(1)
For the purposes of this Division, a person contravenes a civil penalty requirement if the Commissioner determines under section 28(2) that the person has failed to comply with—
(a)
an information notice; or
(b)
an inspection notice.
(2)
A person does not contravene a civil penalty requirement described in subsection (1)(a) if the Commissioner recommends that the Minister issue an Adverse Publicity Notice in relation to that determination in accordance with section 28(3A)(a).
