10 Declaration of a transport project

The Premier may declare a transport project to be a declared project—
to which this Act applies; or

to which this Act (other than Parts 3 and 8) applies.

Subsection (1)(a) does not apply to a transport project that is a program of works or projects.

A declaration under subsection (1) must be published in the Government Gazette and on an Internet site maintained by the Department of Premier and Cabinet.

A declaration under subsection (1)(b) for a transport project that is a program of works or projects must specify the works or projects that constitute the program of works or projects.
A declaration under subsection (1) takes effect—
on the day the declaration is published in the Government Gazette; or
if the declaration specifies a later day, on that day.
