35 Land to which permit can apply
A construction permit may be issued under this Division over the following land—
leased land;
reserved Link Upgrade project land;

land which is temporarily occupied by the Head, Transport for Victoria for the purposes of the M1 Redevelopment Project under Part 9 of the Land Acquisition and Compensation Act 1986;

Crown land which the Head, Transport for Victoria is permitted to use under section 23;

land vested in the Head, Transport for Victoria;
land that is available land within the meaning of clause 11 of Schedule 3 to the Road Management Act 2004.
