Occupational Health and Safety Regulations 2017

This regulation applies to amusement structures to which AS 3533.1— Amusement rides and devices—Part 1: Design and construction applies, other than amusement structures determined by AS 3533.1 to be class 1.

An employer or self-employed person with the management or control of an amusement structure to which this regulation applies must ensure that—

the details specified in subregulation (3) are recorded in the logbook for the amusement structure; and

the logbook and operating and maintenance manuals for the amusement structure are kept with the amusement structure and available to the Authority for inspection at all times.

For the purposes of subregulation (2)(a), the specified details are—

the item of plant registration number (if any); and

the plant design registration number (if any); and

a statement from the manufacturer confirming their criteria for eligibility of patrons to use the amusement structure; and

for each occasion on which the amusement structure is erected, details of the erection (including the date and location); and

for each occasion on which the amusement structure is stored, details of the storage (including the date, location and storage conditions); and

details of any inspection, maintenance and testing of the amusement structure; and

for each day on which the amusement structure is operated, the number of hours for which it is operated; and

the total number of hours which the amusement structure has been operated from 29 July 2026; and

details of any faults, or other matters relevant to the safety of the amusement structure, identified during its operation, inspection, maintenance or testing; and

if applicable, any action taken in response to any faults or matters in relation to which details have been provided under paragraph (i); and

the following details for each person who operates the amusement structure—

the person's full name;

whether the person has been provided with instruction and training in the proper operation of the amusement structure;

for each occasion on which instruction or training in the proper operation of the amusement structure is provided to the person—

the date of the instruction or training; and

a summary of the instruction or training; and

the name and qualifications or experience of the instructor or trainer; and

details of any statutory notice or direction issued by an inspector in relation to the amusement structure, including—

the date on which the notice or direction was issued; and

the reasons for issuing the notice or direction; and

any action taken in response to the notice or direction; and

whether compliance was achieved or the notice was withdrawn; and

for a notice given by a corresponding Authority, the location of the amusement structure when the notice was issued.

An employer or self-employed person who manages or controls an amusement structure to which this regulation applies must ensure that persons involved in the commissioning, installation, use, inspection, maintenance, storage and testing, and the decommissioning, dismantling and disposal, of the amusement structure are given access to—

the logbook for the amusement structure, other than the information specified in regulation 106A(3)(k)(iii); and

the operating and maintenance manuals for the amusement structure.

An employer or self-employed person who manages or controls an amusement structure to which this regulation applies must provide a copy of the logbook and operating and maintenance manuals for the amusement structure to any person to whom the person relinquishes control of the amusement structure.

For the purposes of this regulation, inspector also includes—

an inspector appointed under section 12 of the Equipment (Public Safety) Act 1994; and

an inspector appointed by a corresponding Authority.

In this regulation—

a non-disturbance notice issued under section 110 of the Act or section 19 of the Equipment (Public Safety) Act 1994;

an improvement notice issued under section 111 of the Act or section 19A of the Equipment (Public Safety) Act 1994;

a prohibition notice issued under section 112 of the Act or section 19B of the Equipment (Public Safety) Act 1994;

an infringement notice issued under section 139 of the Act or section 27 of the Equipment (Public Safety) Act 1994;

a non-disturbance notice, improvement notice, prohibition notice or infringement notice issued by a corresponding Authority.
