The Ombudsman must notify the Information Commissioner of a complaint if the complaint could be made the subject of a complaint under Part VIA of the Freedom of Information Act 1982.

If the Ombudsman notifies the Information Commissioner of a complaint under this section, the Ombudsman must advise the complainant that the complaint has been notified to the Information Commissioner to be dealt with under Part VIA of the Freedom of Information Act 1982.
