16J Notice of referral
If the Ombudsman refers a complaint to a person or body under section 16I or 16IA, the Ombudsman—
S. 16J(1)(a) substituted by No. 2/2019 s. 160(b).
must advise the complainant that the complaint has been referred to the person or body; and
may inform the following in writing—
the principal officer (if any) of the authority to which the complaint relates; and
the responsible Minister for the authority to which the complaint relates; and
S. 16J(1)(b)(iii) amended by No. 45/2025 s. 275(1)(a).
if the authority to which the complaint relates is a member of staff of a Council, the Mayor of the Council; and
S. 16J(1)(b)(iv) inserted by No. 45/2025 s. 275(1)(b).
if the authority to which the complaint relates is Gellung Warl, the First Peoples' Assembly Chairperson.
S. 16J(2) inserted by No. 45/2025 s. 275(2).
Subsection (1)(b)(ii) does not apply in relation to a complaint which relates to Gellung Warl.
