17 Incapacity of Department Head
The Governor in Council, on the recommendation of a Board of Inquiry appointed in accordance with section 15, may dispense with the services of a Department Head if—
(a)
the Department Head is at any time found to be unfit to discharge the duties of his or her office or to be inefficient in, or incapable of, the prompt and effective discharge of his or her duties; and
(b)
the unfitness, inefficiency or incapacity is likely to be of a permanent character.
