107 Transfers
S. 107(1) amended by No. 57/2009 s. 38.
If the holder of an authority, other than a special drilling authorisation, wishes to transfer the authority to another person, either it or the person to whom the authority is to be transferred may apply to the Minister for approval of the transfer.
A person applying for the approval of a transfer—
must apply for the approval in the manner required by the Minister; and
must submit the following details concerning the person to whom the authority is to be transferred—
its relevant technical qualifications and the relevant technical qualifications of its employees; and
the relevant technical advice available to it; and
the financial resources available to it; and
must submit evidence of the ability of the person to whom the authority is to be transferred to comply with this Act; and
must submit any other details or matter required by the Minister to enable the Minister to assess the application; and
may set out other matters that it wishes the Minister to consider; and
must submit a transfer document in the form approved by the Minister that has been executed by the parties to the proposed transfer.
