Restrictions on ability of Minister to grant application

In force

The Minister may only grant an application if the Minister is satisfied—

(a)

that the holder of the production licence is not using the reservoir and has no present intention to use the reservoir; and

(b)

that the excision of the land will not interfere with the operations of the holder of the production licence.
