63 Prescribed circumstances—Minister may require variation of accepted operation plan
For the purposes of section 163A(2)(e) of the Act, the prescribed circumstances are that—
(a)
at least 5 years has elapsed after the date on which either—
(i)
the Minister accepted the accepted exempt operation plan; or
(ii)
a significant change report was submitted to the Minister in relation to the accepted exempt operation plan; and
(b)
the accepted exempt operation plan has not been varied under section 163 or 163A of the Act.
