Improvement notice

In force

(1)

This section applies if an inspector reasonably believes that a licensee—

(a)

is contravening this Act; or

(b)

has contravened this Act in circumstances that make it likely that the contravention will occur again; or

(c)

is not complying with a condition of the licence; or

(d)

has failed to comply with a condition of the licence in circumstances that make it likely that the failure will occur again.

(2)

The inspector may issue to the licensee an improvement notice requiring the licensee to take specified action within a specified period to stop the contravention, or failure to comply, from continuing or occurring again.

(3)

The licensee must comply with the notice.

In the case of a natural person, 240 penalty units;

In the case of a body corporate, 1200 penalty units.
