158F Notice of proposal to proceed on the basis of documents
If a panel proposes to make a decision under section 158G(1)(b) or (c) it must give notice to—
the Minister; and
the relevant planning authority; and
any person who made a submission that is referred to the panel; and
any responsible authority or council concerned; and
any person who asked the planning authority to prepare the amendment; and
any person whom the Minister or planning authority directs the panel to hear.
A notice under subsection (1) must—
state that the panel proposes to consider a submission referred to it or give a person a reasonable opportunity to be heard under section 24 on the basis of documents; and
be given within 10 business days after the day on which the submissions were referred to the panel; and
specify the date by which a person referred to in subsection (1) may make a written submission to the panel about the proposed decision.
The date specified in the notice must be no earlier than 10 business days after the day on which the notice is given to the applicant.
The panel must consider each submission about the proposed decision within 5 business days after the date specified in the notice.

After considering the submissions made to it under this section, the panel may make a decision under section 158G(1)(b) or (c).
