187A Secretary may delegate powers under Part 9AB
The Secretary to the Department, by instrument, may delegate a power, duty or function of the Secretary under Part 9AB to—
an Administrative Office Head (within the meaning of the Public Administration Act 2004); or
a person employed under Part 3 of the Public Administration Act 2004; or
a person engaged by the Secretary; or
a public authority (within the meaning of Part 9AB).
A person to whom a power, duty or function under Part 9AB has been delegated under a delegation under subsection (1), subject to any conditions or limitations to which the delegation is subject, may sub-delegate the power, duty or function delegated to them to any of the following persons if the instrument of delegation authorises its sub-delegation—
an Administrative Office Head (within the meaning of the Public Administration Act 2004); or
a person employed under Part 3 of the Public Administration Act 2004; or
a person engaged by the Secretary; or
a public authority (within the meaning of Part 9AB); or
a person employed by a public authority (within the meaning of Part 9AB).
Sections 42 and 42A of the Interpretation of Legislation Act 1984 apply to a sub‑delegation authorised by this section in the same way as they apply to a delegation.
