73C Process for making towage service determination
Subject to subsection (2), Ports Victoria must publish notice of a proposal to make a towage service determination in the Government Gazette before making the determination.
Ports Victoria must consult the port manager of a commercial trading port on a proposal to make a towage service determination that will apply to a towage service provided in the commercial trading port at least 30 days before publishing a notice under subsection (1).
A notice under subsection (1) must be published at least one month before the making of the determination.
A notice under subsection (1) must set out—
the proposed form and content of the determination; and
the fact that written submissions may be made on the proposed determination to Ports Victoria; and
the time within which the written submissions must be made under section 73D.
