Port Management Act 1995

In preparing a Rail Access Strategy, the port of Melbourne operator must consult with—

port of Melbourne users; and

owners and tenants of port of Melbourne land; and

licensees at the port of Melbourne; and

persons who wish to design, construct or operate rail infrastructure at the port of Melbourne; and

persons who wish to provide rail freight services at the port of Melbourne; and

relevant government agencies; and

any stakeholders specified in guidelines.

If there are guidelines in effect that set out a process for consultation with the persons and entities listed in subsection (1), the port of Melbourne operator must, in preparing a Rail Access Strategy, consult with those persons and entities in accordance with the guidelines.
