38Y Requests for access
S. 38Y(1) amended by No. 30/2021 s. 92(1).
An access seeker who wants to be provided with declared rail transport services must request access to those services in accordance with this section.
The access seeker must submit a request for access to the access provider who provides the declared rail transport services.
A request must be in writing and contain the following—

a description of the declared rail transport services that the access seeker wants to be provided with;
a description of the services that the access seeker will provide through the use of the declared rail transport services;
details of the access seeker's—
management competency; and
financial viability; and
relevant policies of insurance.
