38ZA Meaning of access regime dispute
An access regime dispute is a dispute between an access provider and an access seeker where the access provider and access seeker are unable to agree as to the terms and conditions for the provision of a declared rail transport service to the access seeker.
In addition, an access regime dispute is taken to arise between an access provider and an access seeker if—
an access seeker is of the opinion that—
an access provider has not complied with section 38W; or
an access provider's rail access arrangement does not meet the requirements of Division 5; or
an access provider rejects a request for access under section 38Z; or
the access provider's rail access arrangement does not comply with an applicable rail access agreement content order.
