For the purposes of section 35(3) of the Act, the Secretary must record demerit points in the Demerits Register in relation to the day on which the offence was committed.

For the purposes of subregulation (1), if a proceeding for an offence is adjourned under section 59(2) of the Criminal Procedure Act 2009 or section 193(1) of the Youth Justice Act 2024, the offence is taken to have been committed on the day alleged in the charge for the offence.
