Southgate Project Act 1994

On and from the commencement of this section, a public open space contribution cannot be required and is not payable under section 18 of the Subdivision Act 1988 or a planning scheme or permit under the Planning and Environment Act 1987 in respect of the project land.

This section has effect despite anything to the contrary in a planning scheme or permit under the Planning and Environment Act 1987.

Subsections (1) and (2) do not affect any public open space contribution paid in respect of the project land before the commencement of this section.

Subject to subsections (1) and (2) this Act does not otherwise affect the operation of the Planning and Environment Act 1987 or an agreement or other instrument under that Act.
