16 Spent conviction order determined with hearing
The Magistrates' Court may hold a hearing to determine an application under section 11.
A hearing must be closed to the public unless the Court considers that the circumstances of the case justify the hearing being open to the public.
If the Court holds a hearing the Court must give written notice of the time, date and place of the hearing to the following persons—
the applicant;
the Attorney-General;
the Chief Commissioner of Police.
If a hearing is closed to the public, the Court must provide directions on which persons may be present at the hearing in addition to the persons specified in subsection (3).
