Subject to subsection (2), if a regulatory impact statement has been prepared for a proposed legislative instrument, the responsible instrument maker must ensure that a notice in accordance with subsection (3) is published in—

the Government Gazette; and

a daily newspaper circulating generally throughout Victoria; and

if the responsible instrument maker considers it appropriate, in such trade, professional or public interest publications as the responsible instrument maker determines.

If the Governor in Council is the instrument maker for a proposed legislative instrument, the responsible Minister must ensure that the notice required by subsection (1) is published in accordance with that subsection.

A notice must—

state the reason for, and the objectives of, the proposed legislative instrument;

summarise the results of the regulatory impact statement;

specify where a copy of the regulatory impact statement and of the proposed legislative instrument can be obtained;

invite public comments or submissions within the time specified in the notice, being not less than 28 days from the publication of the notice.

The responsible instrument maker, or if the Governor in Council is the instrument maker, the responsible Minister, must ensure that all comments and submissions are considered before the legislative instrument is made.
