2.36 Attendance of appellant
(1)
The appellant is entitled to attend the hearing of an appeal or an application for leave to appeal unless the Court of Appeal or a Judge of Appeal directs otherwise or these Rules otherwise provide.
(2)
If the appellant does not attend in court on the hearing, the appeal or the application may be heard and determined in the appellant's absence.
(3)
If the appellant so elects, the appellant may attend before the Court by appearance by audiovisual link, if it is practicable to do so.
(4)
In relation to a Crown appeal, this Rule shall be read and construed as if the word "appellant" were "respondent".
