However, in disclosing information under subsection (1), an authorised discloser must not disclose information if doing so is prohibited by section 22EK.

Despite anything in subsection (1), a person who is an authorised discloser because they are a program provider must not disclose information about a relevant person under subsection (1) unless they are a program provider in respect of that relevant person.

Section 22AE sets out when a program provider is a program provider in respect of a relevant person.
