22CX Court must review conditions at review hearing
S. 22CX inserted by No. 47/2021 s. 6.
(1)
At a review hearing for a support and engagement order to which conditions were attached in accordance with section 22CR, the court must consider, for each condition, whether—
(a)
that condition remains an appropriate way to achieve a therapeutic purpose for the supported person; and
(b)
the condition is no more restrictive than is necessary to achieve that purpose.
(2)
If the court considers that a condition does not accord with subsection (1), the court must either—
(a)
vary the condition so that it does accord with that subsection; or
(b)
revoke the condition.
