42 Functions of gambling and casino inspectors

A gambling and casino inspector has the following functions—
S. 42(1)(a) amended by No. 26/2022 s. 52(2).
any functions conferred on a gambling and casino inspector under gambling legislation;
S. 42(1)(b) amended by No. 26/2022 s. 52(2)(a).
any functions conferred on a gambling and casino inspector under the Racing Act 1958 and any regulations made under that Act;
S. 42(1)(c) amended by No. 26/2022 s. 52(2)(a).
any other functions conferred on a gambling and casino inspector under this Act, any other Act or regulations made under this Act or any other Act.
S. 42(2) substituted by No. 26/2022 s. 52(3).
A gambling and casino inspector has all the powers necessary to perform the inspector's functions under gambling legislation.

Without limiting subsection (2), a gambling and casino inspector may—
S. 42(3)(a) amended by No. 26/2022 s. 52(4)(b).
with the approval of the Commission, bring proceedings for offences against this Act or gambling legislation;
S. 42(3)(b) substituted by No. 26/2022 s. 52(4)(c).
appear personally or be represented by an Australian lawyer in any proceeding the inspector becomes involved in as a consequence of performing functions as a gambling and casino inspector.
