5A Ministerial directions
Subject to subsection (2), the Minister may give a written direction to the Commission in relation to the performance of its functions and duties or the exercise of its powers.
A direction cannot be given under this section in relation to—
the content of any advice, report or recommendation given to the Minister by the Commission; or
the granting, issuing, variation, suspension or cancellation of a gambling authorisation; or
the undertaking of an investigation under gambling legislation; or
the taking of disciplinary action under gambling legislation.
Subject to subsection (4), the Minister must cause to be published in the Government Gazette—
a direction given under this section; and
the reasons for giving the direction.
The Minister is not required to publish any information under subsection (3) that in the Minister's opinion is confidential or commercially sensitive.
To avoid doubt, subsection (2) does not affect a power of the Minister to give directions to the Commission under another Act.
Example
Under section 24 of the Casino Control Act 1991 the Minister may direct the Commission to investigate a casino.
