Voluntary Assisted Dying Act 2017

Subject to subsection (3), the co-ordinating medical practitioner for a person may apply to the Secretary for a self-administration permit in respect of the person if the person is physically able to self-administer and digest the poison or controlled substance or the drug of dependence proposed to be specified in the permit for the purpose of causing the person's death.

An application for a self-administration permit must—

be in the prescribed form; and

identify the person in respect of whom the permit is sought; and

specify the poison or controlled substance or the drug of dependence the applicant seeks to prescribe or supply in a sufficient dose to the person, for the purpose of self-administration to cause the person's death; and

specify the contact person in respect of the person; and

be accompanied by a copy of the completed final review form and all forms referred to in section 41(1)(a); and

be accompanied by a statement that the applicant is satisfied of the matters specified in subsection (3).

The co-ordinating medical practitioner must not apply for a self-administration permit unless the co-ordinating medical practitioner is satisfied that—

the person has decision-making capacity in relation to voluntary assisted dying; and

the person's request for access to voluntary assisted dying is enduring.
