Schedule 12ARecording mortgages of water shares
7 Notifying the Registrar
(1)
Subject to this Schedule, if a mortgagee of a recorded mortgage of a water share exercises a power of sale under clause 6, a person may lodge with the Registrar a transfer for the recording of that sale in the water register.
(2)
A transfer under subclause (1) must be in the approved form.
(3)
If transfer under this clause is in the approved form and is expressed to be in exercise of a power of sale under clause 6, the Registrar may accept that transfer as sufficient evidence that the power has been duly exercised.
