36 Consideration of application for NDIS check made by holder of NDIS clearance
This section applies if—
S. 36(1)(a) amended by No. 20/2025 s. 15.
a person who holds an NDIS clearance applies in accordance with section 35 for the carrying out of an NDIS check; and
S. 36(1)(b) amended by No. 58/2025 s. 125(Sch. 2 item 1.46).
the Regulator has not been notified of any relevant change in circumstances set out in section 34(2).

The Regulator may consider the application without having regard to any offence or conduct that was considered by the Regulator in relation to the decision to give the current NDIS clearance.
