41 NDIS category A re‑assessments

A re‑assessment is an NDIS category A re‑assessment if the Regulator is required to re‑assess a person's eligibility to hold an NDIS clearance because the Regulator is notified that—

the person has become subject to reporting obligations imposed by the Sex Offenders Registration Act 2004; or
the person has become subject to a supervision order, a detention order or an emergency detention order; or
the person has been convicted or found guilty of an NDIS category A offence specified in clauses 1 to 58 of Schedule 1 if the conduct constituting that offence occurred when the person was an adult; or
subject to section 43(2), the person has been convicted or found guilty of an NDIS category A offence specified in clauses 59 to 71 of Schedule 1 if the conduct constituting that offence occurred when the person was an adult.
For the purposes of this section, if the conduct constituting an offence occurs between 2 dates, one on which the person was a child and one on which the person was an adult, that conduct occurs when the person was an adult.
