91 Revocation of WWC clearance after completing re‑assessment and surrender of document

If the Regulator revokes a person's WWC clearance under section 83, 85 or 87, the Regulator must give the person a WWC exclusion.

If the Regulator revokes a person's WWC clearance, the Regulator must give the person a written notice that—

subject to subsection (2A), states the reasons for revoking the person's WWC clearance and giving the person a WWC exclusion; and
S. 91(2)(b) substituted by No. 58/2025 s. 119.
states that the applicant may apply for internal review under section 92A or make a further application under section 92B; and
S. 91(2)(c) substituted by No. 58/2025 s. 119.
explains how those applications may be made.

Subsection (2)(a) does not apply if—
the WWC clearance has been revoked under section 87; and
the reason for the decision to revoke the WWC clearance and give the WWC exclusion is child safety risk information; and
the Chief Commissioner of Police or the Regulator is satisfied that disclosing that information in the notice would—
prejudice an investigation; or
enable the discovery of the existence or identity of a confidential source of information relevant to law enforcement; or
pose a serious risk to the safety of any person.

The Regulator may give a notice to a person whose WWC clearance is revoked or has expired requiring the person to surrender the WWC clearance document to the Regulator in the manner specified in the notice and within the period for doing so specified in the notice.
A person must not, without reasonable excuse, refuse or fail to surrender a document as required by a notice under subsection (3).
Penalty: Level 9 fine (60 penalty units maximum).

If the Regulator—
gives a notice under subsection (3) on the expiry of a WWC clearance; and
is aware that the person whose WWC clearance has expired is a person who—
is, or is proposed to be, engaged in child-related work by another person; or
is listed with an agency—
the Regulator, if the Regulator is aware of the identity of that other person or that agency, must notify that other person or that agency in writing of the expiry.
