Seizure
76 Seizure
A police officer may seize any thing found during a search under section 75(1) if the police officer believes on reasonable grounds the thing—
presents a danger to the health and safety of the child or another person; or
could be used by the child to avoid transportation; or
is stolen; or
has been used in, or obtained as the result of, the commission of an offence.
Any thing that is seized under subsection (1) or that has been given to a police officer by the child must be returned to the child, or a suitable person the child is being placed into the care of, once the transport power is no longer being exercised in respect of the child unless there is a lawful reason to not return the thing.
