73 Adoption plan, Court may dispense with requirement for
The Court may dispense with the requirement for an adoption plan or that a particular birth parent be a party to the plan —
(a)
if a birth parent is —
(i)
unable or unwilling to participate, or incapable of participating, in a plan; or
(ii)
cannot be found or contacted after enquiries which the Court thinks are sufficient;
or
(b)
in special circumstances.
