147 Property remains vested in the State in certain cases
This section applies to the following classes of fauna —
fauna taken in accordance with a licence or authorisation under this Act that authorises the capture of live fauna;
injured fauna or abandoned fauna captured, rescued, received or temporarily cared for under section 161 or regulations referred to in that section.
Despite section 146(2), the property in fauna of a class to which this section applies continues to be vested in the State unless the Minister makes an order under subsection (3).
The Minister may, by order, declare that the property in fauna of a class to which this section applies ceases to be vested in the State.
An order made under subsection (3) must specify the time at which property ceases to be vested in the State.
Section 258 applies to an order made under subsection (3).
