162 Releasing fauna
(1)
A person must not release fauna in any part of the State unless the person has lawful authority to release it.
Penalty for this subsection: a fine of $20 000.
(2)
It is a defence to a charge of an offence under subsection (1) to prove that —
(a)
the fauna had been taken in circumstances giving rise to a defence under section 151(1) or (2) or in circumstances beyond the control of the person charged; and
(b)
the release occurred in circumstances in which it was reasonable to expect the fauna to be able to fend for itself.
