Before the listing of habitat as critical habitat or the amendment or repeal of such a listing, the CEO must take reasonable steps to give written notice of the proposed listing, amendment or repeal to the owner or occupier of the land on which the habitat is located.

A notice under subsection (1) must —

contain sufficient information to enable the location and extent of the habitat to be identified; and

in the case of a proposed listing, contain information as to the effect of the listing of habitat as critical habitat under this Act; and

specify a period within which submissions may be made to the Minister in respect of the proposed listing, amendment or repeal.
