44 Compliance with occupancy permit generally
(1)
Each owner of a building for which an occupancy permit is in effect must ensure that the occupancy permit is complied with including each condition that applies to the permit.
Penalty:
(a)
for a first offence, a fine of $50 000;
(b)
for a second offence, a fine of $75 000;
(c)
for a third or subsequent offence, a fine of $100 000 and imprisonment for 12 months.
(2)
Subsection (1) does not apply to a matter to which section 43(1) applies.
