Civil Judgments Enforcement Act 2004

Any of the following persons may apply to a court for directions in respect of a matter arising under or in connection with the operation or carrying out of an order issued under this Act —

the person who obtained the order; or

a person to whom the order is addressed; or

a person who is authorised to do anything under the order; or

a person who is affected by, or whose property is affected by, the order; or

a person who in the opinion of the court has a sufficient interest in the matter.

Such an application must be made —

if the order relates to personal property, to the court that issued the order;

if the order relates to real property —

to the Supreme Court if the order was issued by the Supreme Court;

to the District Court if the order was issued by the District Court or the Magistrates Court.

On such an application, the court may —

give any directions that are just; and

make any order as to the payment of the costs of the application as are just.
