50 Debt appropriation order, content and service of

(1)

A debt appropriation order is to —

(a)

be addressed to the person who owes or will or may owe the available debt; and

(b)

state the name and address of the judgment debtor and the judgment creditor; and

(c)

state the judgment debt as at the date of the order; and

(d)

identify the available debt to which the order applies; and

(e)

if the available debt is, will be or may be owed to the judgment debtor jointly with another or others, state the portion of the available debt to which the order applies; and

(f)

order the third person to pay the judgment creditor —

(i)

the whole of the appropriated debt; or

(ii)

such of the appropriated debt as will satisfy the judgment debt,

as the case requires, after retaining any amount to which the third person is entitled under section 53(1); and

(g)

contain any other information that is prescribed by the regulations.

(2)

The judgment creditor must serve the debt appropriation order on the third person in accordance with the regulations.
