305 Application for transfer

(1)

A co‑operative, if approved under this Division, may apply to become registered or incorporated as one of the following corporations —

(a)

a company under the Corporations Act;

(b)

an incorporated association under the Associations Incorporation Act 2015;

(c)

a corporation that is incorporated, registered or otherwise established under a law that is a law of a place outside this State and that is prescribed by the regulations.

(2)

For the purposes of subsection (1)(a), an application is to be made in accordance with the Corporations Act section 601BC for registration as a company under Part 5B of that Act.

(3)

For the purposes of the Corporations Act section 601BC(8)(d), a co‑operative is authorised by this Act to transfer its incorporation.
