482E Compensation orders
The Supreme Court may order a person to compensate a co‑operative for damage suffered by the co‑operative if —
the person has contravened a civil penalty provision in relation to the co‑operative; and
the damage resulted from the contravention.
The order must specify the amount of the compensation.
A compensation order may be made under this section —
whether or not a declaration of contravention has been made under section 482B; and
whether or not the person has been convicted of an offence for contravening the civil penalty provision.
In determining the damage suffered by the co‑operative for the purposes of making a compensation order, profits made by any person resulting from the contravention are to be included.
A compensation order may be enforced as if it were a judgment of the Supreme Court.
