Matters to be taken into account in making a decision as to responsibility for remediation

In force

(1)

A decision as to responsibility for remediation is to be made in accordance with Division 1 and the section which empowers the decision to be made.

(2)

In making a decision as to responsibility for remediation the committee is to take into consideration —

(a)

the contents of any notice given by the committee under section 37; and

(b)

any submission made to the committee referred to in section 37(e) and any information or documents provided in support of the reasons given in that submission,

and may take into consideration any other matters the committee considers relevant.
