The nominating committee must, on the Premier’s written request, submit to the Premier a list of 3 persons qualified and eligible under section 10 for appointment.

The Premier’s request must specify for which of the following purposes the list is required —

recommending the appointment of a person as Commissioner under section 9A(1);

recommending the appointment of a person as Deputy Commissioner under section 9A(1);

recommending the appointment of a person to act in the office of Commissioner under section 14.

Before submitting a list under subsection (1), the nominating committee must —

advertise throughout Australia for expressions of interest; and

if the Premier’s request specifies that the list is for the purpose of recommending the appointment of a person as Deputy Commissioner under section 9A(1) and there is a Commissioner appointed under section 9A(1) — consult with the Commissioner.
