When forensic procedure may be done on volunteer
81 When forensic procedure may be done on volunteer
A forensic procedure may only be done on a volunteer if section 80 is complied with and —
in the case of an adult — he or she consents to undergoing the forensic procedure;
in the case of a protected person who is a child who has reached 10 years of age —
the child consents to undergoing the forensic procedure; and
the responsible person consents to the child undergoing the procedure;
in the case of a protected person who is a child under 10 years of age or an incapable person — the responsible person consents to the protected person undergoing the procedure.
If before a forensic procedure is completed on a volunteer —
the volunteer objects to or resists the carrying out of the procedure; or
any consent required under subsection (1) is withdrawn,
the procedure must not be completed.
