23 Persons serving sentences or carrying out orders in respect of offences or alleged offences
This section applies to a person on whom a sentence is imposed, or against whom an order is made or issued, in respect of an offence or alleged offence under the law of a participating jurisdiction.
The person has a connection with a cross‑border region if —
the sentence was imposed, or the order was made or issued, in —
a cross‑border proceeding of a prescribed court of the participating jurisdiction for the purposes of which the person had a connection with the region; or
an appeal from such a proceeding;
or
if the order was made or issued for the purpose of enforcing a fine — the fine was imposed in a proceeding or appeal referred to in paragraph (a); or
the person ordinarily resides in the region.
