In this Part —
advocate —
if the Mental Health Act 1996 Part 9 is in operation, means a member of the Council of Official Visitors established under section 176 of that Act; or
if the Mental Health Act 1996 Part 9 is no longer in operation, means a person belonging to a class of persons prescribed by regulation;
chief advocate —
if the Mental Health Act 1996 Part 9 is in operation, means the Head of the Council of Official Visitors appointed under section 177(1)(a) of that Act; or
if the Mental Health Act 1996 Part 9 is no longer in operation, means the person prescribed by regulation.
