Electoral Act 1907

A person is entitled to be enrolled for a district if —

the person has attained 16 years of age but has not attained 18 years of age or subsection (3) applies; and

the person would be entitled to be enrolled for the district if the person had attained 18 years of age.

For the purposes of this Act, until a person who is enrolled under subsection (1) attains 18 years of age, the person —

is taken not to be an elector; and

is not entitled to vote in an election; and

is taken to be a silent elector.

For the purposes of subsection (1)(a) and section 44(4)(a), this subsection applies if —

the person who claims to be entitled to be enrolled does not know their age; and

a claim for enrolment contains a statement to that effect; and

a person who may attest as to the person’s identity under the Commonwealth Electoral Act 1918 section 98AA(2)(c), in relation to an application or claim to which that section applies, certifies in writing that they are satisfied that the claimant has attained 16 years of age and is under 18 years of age.
