196 Employer to allow employee leave of absence to vote
If an employee who is an elector notifies the elector’s employer before polling day that the elector would like a leave of absence to enable them to vote in any election, the employer must, if the absence desired is necessary to enable the employee to vote in the election, allow them a leave of absence without any penalty or disproportionate deduction of pay for such reasonable period not exceeding 2 hours as is necessary to enable the employee to vote in the election.
No employee shall, under pretence that they intend to vote in the election, but without the bona fide intention of doing so, obtain leave of absence under this section.
This section shall not apply to any elector whose absence may cause danger or substantial loss in respect of the employment in which the person is engaged.
